These Terms of Use govern access to and use of Diagnostics Elite websites, applications, and related services. By accessing or using our services, you agree to these terms.
1. Acceptance of terms
If you use our services on behalf of a hospital, clinic, or other organization, you represent that you are authorized to bind that organization to these terms. If you do not agree, do not use our services.
2. Services description
Diagnostics Elite provides teleradiology, PACS and imaging workflow tools (including DePACS Butterfly), DeHub and related applications, second-opinion facilitation, education resources, and related support. Specific clinical services may be subject to separate service agreements, SLAs, or statements of work with your organization.
3. Accounts and access
You are responsible for safeguarding credentials and for activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate access for security, misuse, or breach of these terms or applicable agreements.
4. Acceptable use
You agree not to misuse our services, including by attempting unauthorized access, disrupting systems, uploading malware, infringing intellectual property, submitting unlawful or inaccurate clinical data, or using the platform outside the scope authorized by your organization and applicable law.
5. Clinical responsibility
Our platforms and second-opinion services support clinical workflows; they do not replace the professional judgment of licensed clinicians responsible for patient care. Referring facilities remain responsible for patient consent, ordering appropriateness, and integrating reports into local care pathways as required by law and their policies.
6. Intellectual property
All trademarks, software, content, and branding of Diagnostics Elite remain our property or that of our licensors. You receive a limited, non-exclusive, non-transferable right to use the services as authorized. You may not copy, reverse engineer, or redistribute our software or content except as expressly permitted.
7. Disclaimers and limitation of liability
Services are provided with professional care commensurate with industry practice. To the fullest extent permitted by law, we disclaim warranties not expressly stated in a signed agreement, and our aggregate liability arising from use of the website or general platforms is limited as set out in applicable contracts or, where none apply, to the maximum extent allowed under Saudi law. Nothing in these terms excludes liability that cannot be excluded by law.
8. Governing law and changes
These terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes shall be subject to the competent courts of Saudi Arabia, unless a signed agreement specifies otherwise. We may update these Terms of Use by posting a revised version on this page. Material changes to contracted clinical services will be handled under those agreements.
